Louisiana is authorized to implement and govern RCRA regulations involving hazardous and solid waste. The Louisiana Department of Environmental Quality Office of Environmental Compliance is the regulating body that carries out these responsibilities, and it ensures that any ensuing regulations are at least as stringent as those at the federal level.
Louisiana is one of the top 10 states for crude oil production. While wastes generated in the crude oil production process are considered “special wastes” and are exempted from RCRA hazardous waste regulation under Subtitle C, they are not exempted from state regulations or solid waste regulations under Subtitle D of the RCRA.
