Waste management programs are initiated, implemented, and enforced by the Massachusetts Department of Environmental Protection (MassDEP). These powers are granted by the EPA; Massachusetts is an authorized state, which means that it can act independently to implement and enforce the requirements of the RCRA. The waste management laws of Massachusetts follow the federal ones, but they are in some cases more restrictive.
The MassDEP is responsible for licensing all hazardous waste facilities. Once distributed, licenses are valid for a period of five years; these licenses must be renewed before their expiration date. If at any point the hazardous waste facility intends to alter the types of wastes that it accepts, install new equipment, or make many other general changes, the company must apply to the MassDEP for a license modification.
