The New Mexico Environmental Department regulates the disposal of general waste, while a more specific branch of this body, the Hazardous Waste Bureau, oversees the “treatment, storage, and disposal facilities” of hazardous materials and hazardous waste generators. New Mexico complies with all federal regulations and is authorized to carry out RCRA regulations. Although the state can handle radioactive mixed wastes (waste that is hazardous and has radioactive components heavier than uranium), it cannot regulate the radiological components of materials going to New Mexico’s Waste Isolation Pilot Plant (WIPP).
